1. Acceptance of Terms

By accessing or using StudyGrab ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

StudyGrab is an aggregation platform that connects users with paid research opportunities, focus groups, and user studies ("Opportunities"). We act as a discovery engine and intermediary between users and third-party study providers (such as researchers on Reddit, User Interviews, Respondent, Prolific, etc.). We do not conduct studies ourselves, nor do we guarantee the availability, quality, or payment of any Opportunity.

3. Eligibility

To use our Service, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Provide accurate and complete information during registration
• Comply with all applicable laws and regulations

If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

4. User Accounts and Registration

To access certain features of the Service (such as viewing the direct links to studies), you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription Services

Some features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your subscription ($7/month)
• Automatic renewal of your subscription unless cancelled
• Comply with Stripe's payment terms (our payment processor)

Subscription fees are non-refundable except as required by law or at our sole discretion. You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will retain access to premium features until the end of your current billing cycle.

6. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems to scrape or access the Service without permission
• Impersonate any person or entity
• Provide false or misleading information in study screeners
• Collect or harvest information about other users

7. Third-Party Opportunities

The Opportunities listed on our platform are provided by third-party study providers. We are not responsible for:

• The accuracy of Opportunity descriptions or requirements
• The availability, cancellation, or modification of Opportunities
• Payment delays, disputes, or non-payment by study providers
• The quality, safety, or legality of any Opportunity
• Any interactions between you and study providers

You acknowledge that your participation in any Opportunity is at your own risk, and you are solely responsible for verifying the legitimacy and terms of any Opportunity before participating.

8. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF ANY OPPORTUNITIES
• WARRANTIES THAT DEFECTS WILL BE CORRECTED

We do not guarantee that you will be selected for any Opportunity, that you will receive payment, or that any Opportunity will meet your expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, DATA, OR USE
• BUSINESS INTERRUPTION
• PERSONAL INJURY OR PROPERTY DAMAGE
• DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
• DAMAGES ARISING FROM YOUR PARTICIPATION IN ANY OPPORTUNITY

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless StudyGrab, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your participation in any Opportunity

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• At our sole discretion

You may terminate your account at any time by contacting us or deleting your account through the Service. Upon termination, your right to use the Service will immediately cease.

13. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive your right to a jury trial and to participate in class actions.
